General protections are intended to protect workplace rights,  provide protection from workplace discrimination, andprovide effective relief for persons who have been discriminated against, victimised, or have experienced other unfair treatment.

A general protections dispute occurs when adverse action is taken, or when a threat to take adverse action occurs because a person has one of these rights, exercises such a right or, in some cases, proposes to exercise such a right.

Why you need to know what adverse action is.

Adverse action is taken by an employer representative against an employee if the employer threatens to, organises, or takes action by:

  • dismissing the employee
  • injuring the employee in his or her employment
  • altering the position of the employee to the employee’s prejudice or
  • discriminating between the employee and other employees of the employer
