Do you know what the rules or principles of Natural Justice and Procedural Fairness are, and why it’s important that you do?
These principles have been developed to ensure that decision making is fair and reasonable and involves decision makers informing people of the case against them or their interests, giving them a right to be heard.
Natural Justice and Procedural fairness allows a person, whose rights or interest may be affected by decisions, the opportunity to:
- Put forward arguments in their favour
- Show cause why proposed action should not be taken
- Deny allegations
- Call evidence to rebut allegations or claims
- Explain allegations or present an innocent explanation
- Provide details of mitigating circumstances
If you are called to a Disciplinary meeting with your Employer Representatives these principles should be applied.
